Court deals setback to efforts to regulate pesticide-coated seeds

A federal court this week dealt a blow to calls for new regulations on pesticide-coated seeds used in farming, ruling that US regulators were not acting improperly in exempting the seeds from registration review.

The US District Court for the Northern District of California on Wednesday granted a summary judgment in favor of the Environmental Protection Agency (EPA) and agrochemical industry lobbyist CropLife America, turning back arguments by the Center for Food Safety and other environmental advocates who have spent years warning of a range of “devastating effects” they say result from widespread use of the specialty seeds.

The concerns addressed in the case focus on seeds that are coated in insecticides before they are planted. Three specific types of insecticides that are part of a class of chemicals known as neonicotinoids present particular threats to beneficial birds and insects such as butterflies, and can contaminate the air, soil and water with toxins, according to critics.

The court case ruled on this week focused on three types of neonics – imidacloprid, thiamethoxam, and clothianidin.

“Neonicotinoid treated seeds are used on at least half of all croplands in the US but pose an extreme danger to birds, bees, and other pollinators,” the Center for Food Safety said in a statement issued Thursday following the ruling. “With the future of agriculture and entire food webs on the line, it is irresponsible and unlawful that these pesticides will continue to be exempted from registration.”

The European Union has banned the outdoor use of certain types of neonicotinoids, also called neonics, and the United Nations has said neonics are so hazardous that they should be “severely” restricted. But in the US, neonics remain widely used, typically as coatings on corn, cotton and soybean seeds, planted by farmers to protect crops from insects and disease.

Scientific research has shown they are contributing to a decline in important pollinators such as honeybees. Environmental advocates say numerous studies show neonics are not necessary.

EPA not protecting public from neonic exposure, analysis suggests

Rodent studies given to US regulators by insecticide makers close to 20 years ago revealed the chemicals could be harmful to the animals’ brain development – data worrisome for humans exposed to the popular pesticides but not properly accounted for by regulators, according to a new research report published this week.

The analysis examined five studies that exposed pregnant rats’ to various types of insecticides known as neonicotinoids (commonly called neonics). The studies found that the offspring born to the exposed rats suffered shrunken brains and other problems.

Statistically significant shrinkage of brain tissue was seen in the offspring of rats exposed to high doses of five types of neonics – acetamiprid, clothianidin, imidacloprid, thiacloprid, and thiamethoxam, the paper states. The authors said the impacts on the brain appeared similar to the effects of nicotine, which they said is known to disrupt mammalian neurological development.

The animal studies also support the possibility of a link between neonic exposure and attention deficit hyperactivity disorder (ADHD), the authors said.

In most cases, the companies submitting the studies did not submit data for all dosage levels, leading the Environmental Protection Agency (EPA) to assume negative effects were only seen at the high dose, according to the study.

“We found numerous deficiencies in the Environmental Protection Agency (EPA)’s regulatory oversight and data analyses,” the authors state in the paper, published in the journal Frontiers in Toxicology. The industry studies, which the EPA used to determine what neonic exposure levels are considered safe for humans, were not publicly available and were obtained through a Freedom of Information Act (FOIA) request.

“Consistently, effects were found at the high dose and EPA did not demand data for the lower doses, therefore leaving it unclear how little of a substance it takes to actually cause adverse effects such as reduced size of certain brain regions,” said Bill Freese, the science director for the environmental advocacy group Center for Food Safety and an author of the study.

Citing birds and bees, groups petition EPA to close pesticide loophole

The US should overhaul regulation of a class of insecticides tied to excessive honeybee and bird deaths, according to a citizen petition filed Wednesday with the Environmental Protection Agency (EPA) by a coalition of more than 60 nonprofit groups.

Specifically, the groups are demanding the EPA revoke a nearly 40-year-old waiver that allows pesticide companies to bring their products to market without first providing data that proves the product benefits. The groups say the waiver dates back to a 1984 EPA declaration that stated: “rather than require efficacy data the Agency presumes that benefits exceed risks”.

The petition, which was submitted by Public Employees for Environmental Responsibility (PEER) and the American Bird Conservancy, is aimed at turning back the use of insecticides known as neonicotinoids, or neonics, which many studies have shown to be exceptionally harmful to hundreds of species.

Environmental advocates say numerous studies show neonics are not necessary and are so detrimental to the environment that they should be banned.

“This stuff is causing all sorts of environmental problems and the environmental tragedy is multiplied because in many cases these insecticides provide farmers no benefit but at the same time they’re doing all this damage,” said Peter Jenkins, a lawyer with PEER.

Neonicotinoids are used across on an estimated 150m acres of US farmland annually.

When used as seed coatings, neonics are absorbed through the roots of plants as they grow. Residues of the chemicals can persist for years in the environment and are blamed, along with other pesticides, for a so-called “insect apocalypse.”
