Mexico’s precaution on GM corn safety is justified

A Presidential decree has banned the use of genetically modified (GM) corn for food in Mexico. But the governments of the United States and Canada are using the US-Canada-Mexico trade agreement (USMCA) to challenge Mexico’s actions.

The purpose of Mexico’s restrictions on GM corn is to safeguard the integrity of native corn from GM contamination and to protect human health. The purpose of the US and Canadian challenge is to defend the interests of the biotechnology industry. The US and Canada want to force Mexico to open its market to all genetically modified foods and seeds. Canada is supporting the US challenge (as a third party in the dispute) even though Canada does not export any corn to Mexico.

Mexico has the right to restrict the use of GM corn. The US argues that Mexico’s actions are not based on scientific principles, but the government has sufficient science to justify its precautionary policies.

Our organization, the Canadian Biotechnology Action Network, is a large network of farmer and environmental groups that has been monitoring the use of genetically modified organisms (GMOs) for over 15 years, and we support Mexico’s restrictions. We were one of two Canadian groups that were given permission to send expert comments on the risks of GM corn to the arbitration panel in this dispute, but in January, Canadian groups were uninvited at the request of the US government, supported by Canada, on the technicality that the dispute is just between the US and Mexico.

We published our analysis anyway, to show that Mexico’s ban is supported by the science. Research continues to find indicators of potential harm to humans from eating GM insect-resistant corn. The science also continues to warn of health impacts from exposure to the herbicide glyphosate, which is used in GM corn production.

Most GM corn plants are genetically modified to kill insect pests. The GM plants express a toxin from the soil bacteria Bacillus thuringiensis (Bt) that is known to harm the guts of specific types of insects but not others. Farmers have long used Bt as a spray to kill pests but the Bt toxins in GM crops are different from this natural Bt in structure, function, and biological effects. In fact, peer-reviewed studies across the scientific literature continue to find that Bt toxins in GM plants can harm insects (spiders, wasps, ladybugs, and lacewings, for example) that are not the intended targets.

New report sparks questions and controversy over possible causes for Iowa “cancer crisis”

Amid increasing scrutiny of a potential link between Iowa farm chemicals and cancer, a new report is generating controversy as it blames rising cancer rates not on the toxins used widely throughout the state, but on something else entirely: binge alcohol consumption.

The Iowa Cancer Registry, a health research group housed at the University of Iowa, reported on February 20 that Iowa has the second-highest and fastest-rising incidence of cancer among all states. An estimated 21,000 new cancer cases are expected to develop this year and 6,100 Iowans will die from cancer, Iowa Cancer Registry Director Mary Charlton said in announcing the new report. Iowa, she said, has the highest rate of binge drinking in the Midwest with 22% of residents reporting binge drinking, more than the national average of 17%. Overall, Iowa has the 4th highest incidence of alcohol-related cancers in the US, according to the report.

“Alcohol is a known carcinogen and a risk factor for several cancers including oral cavity, pharynx, larynx, esophagus, rectum, liver, and female breast cancers,” Charlton said in a news conference.

The assessment has drawn questions and sparked doubts, however, from state leaders and health and environment researchers who have been calling for a probe into just how much the state’s agricultural industry may be contributing to the spread of disease.

“Is alcohol responsible for the increase in cancer incidence here since 2014? I personally doubt that,” said James Merchant, a retired professor of occupational and environmental health, and former dean of the University of Iowa College of Public Health.

“What needs to be looked at are things that are probable or possible carcinogens that have increased beginning about 1990, because of the well-recognized latency of environmental cancers,” Merchants said. “Those carcinogens associated with industrial agriculture are the ones that really need to be looked at very closely.”

Ohio PFAS class action lawyers slam US judges; seek rehearing

A federal appeals court should grant a rehearing in a class action lawsuit filed against the makers of toxic PFAS chemicals after a panel of three federal judges disregarded legal precedent and misstated crucial facts in rejecting claims of liability alleged against PFAS makers, according to a petition filed by plaintiffs’ lawyers in the closely watched legal battle.

The request for rehearing comes after last month’s ruling by the Cincinnati, Ohio-based 6th US Circuit Court of Appeals, which reversed a lower court’s approval of the lawsuit brought on behalf of Ohio residents who want PFAS makers 3M, DuPont and others to pay for medical monitoring and studies that will analyze the health impacts of PFAS contamination the residents have been exposed to. The plaintiff’s attorneys have requested either a panel rehearing; a hearing before all judges of the court; or permission for the plaintiff to refile.

Lead plaintiff Kevin Hardwick worked as a firefighter for 40 years and used PFAS-containing foams at work. He alleges that ten companies, including chemical giants 3M, DuPont, and related companies, caused his blood -and the blood of other Ohio residents – to become contaminated with potentially dangerous levels of PFAS chemicals. The judges who rejected the allegations said in their opinion that Hardwick could not trace the chemicals in his blood back to the ten defendants, citing “the thousands of companies that have manufactured chemicals of this general type over the past half-century.”

In the filing by plaintiffs’ lawyers on Monday, the lawyers for the class action said the judges were factually wrong on multiple fronts, including stating that there are thousands of PFAS manufacturers. One of the PFAS toxins found in Hardwick’s blood is perfluorooctane sulfonic acid (PFOS). PFOS has only been made by defendant 3M, for instance, a fact not even disputed by 3M, the petition states. Another type of PFAS found in his blood was perfluorooctanoic acid (PFOA).

“Defendants do not dispute that they caused PFOA (and other PFAS) to be created and deposited into human blood. Nor do they dispute that that these toxins did not exist before Defendants created them,” the Hardwick petition states. The defendants additionally have been identified by the US EPA as “known makers” of PFOA, according to the petition for rehearing.

Chemical found widely in the environment causes cancer, global experts determine

A group of global scientific cancer experts this week classified a widespread chemical known as PFOA as carcinogenic to humans, confirming decades of research, and building on concerns about human and animal exposure to that chemical and to the larger class of manmade substances that are commonly known as “forever” chemicals because of their persistence in the environment. Separately, the experts deemed a related chemical called PFOS as possibly carcinogenic to humans.

The classifications, published Thursday in The Lancet Oncology, were determined by a working group of 30 experts from around the world through the International Agency for Research on Cancer (IARC), an arm of the World Health Organization (WHO). The experts convened in Lyon, France Nov. 7-14 to review published literature on the health risks of perfluorooctanoic acid (PFOA) and perfluorooctane sulfonic acid (PFOS). Both are types of per-and poly fluoroalkyl substances (PFAS).

“This latest action highlights and reaffirms the concerns we have been raising for decades that these man-made ‘forever chemicals’ present a serious threat to human health, mandating that appropriate steps be taken to prevent and address exposures,” said Rob Bilott, an environmental lawyer for the Ohio-based firm Taft Law who has spent over two decades exposing the dangers of PFAS chemicals.

In classifying PFOA as carcinogenic, the IARC scientists said they found “sufficient” evidence for cancer in experimental animals exposed to PFOA and “strong” evidence that the chemical affects gene expression and immune response in humans exposed to PFOA. They also found limited evidence for cancer in humans, identifying a link to renal cell cancer and testicular cancer.

The scientists said that the research shows PFOS is “possibly” carcinogenic to humans. They said they found strong mechanistic evidence that the chemical affects gene expression and immune response in exposed humans, along with several other key characteristics of carcinogens. They also found limited evidence linking PFOS to cancer in experimental evidence but ‘inadequate evidence’ linking it to cancer in humans.

It remains to be determined how, or if, the new classifications may impact thousands of lawsuits that are pending in US courts against PFAS makers DuPont and 3M. The companies have been sued by individuals as well as by drinking water utilities and municipalities over alleged harms tied to PFAS contamination.

On Monday, a US appeals court turned back a large class action lawsuit brought on behalf of Ohio residents, finding there was not sufficient proof that the companies caused the exposure alleged in the case. Lead plaintiff Kevin Hardwick, who worked as a firefighter for 40 years and used PFAS-containing foams, brought the suit in 2018, alleging that the companies caused his blood to become contaminated with potentially dangerous levels of PFAS chemicals. Hardwick asked for a panel of scientists to study the effects of PFAS in his body and for medical monitoring.

Monsanto accused of wrongly excluding non-US citizen from Roundup settlement

Monsanto Co. and its corporate parent Bayer are facing a federal lawsuit for civil rights violations after they allegedly excluded a farmworker from a Roundup cancer settlement because of her immigration status.

According to the lawsuit, which was filed in the US District Court for the Western District of Virginia, plaintiff Elvira Reyes-Hernandez is a migrant farmworker who worked on Virginia tree farms between 2015 and 2018, during which she sprayed the herbicide Roundup regularly.

In 2015, the World Health Organization’s International Agency for Research on Cancer (IARC) listed glyphosate, the active ingredient in Roundup, as “probably carcinogenic to humans.” Over the years, a wide body of scientific evidence has also pointed to glyphosate exposure as causing an increased risk of non-Hodgkin lymphoma.

Reyes-Hernandez was diagnosed with non-Hodgkin lymphoma in 2019 and subsequently sued Monsanto, claiming that Roundup exposure had a role in causing her cancer.

“Monsanto is very likely making calculated risks based on the characteristics of the people who are using their products,” said Katy Youker, an attorney for Lawyers’ Committee for Civil Rights Under Law and a co-counsel for the case.

By excluding non-US citizens from the settlement program, she said, Monsanto is effectively putting up a huge barrier for migrant farmworkers — most of whom do not have citizenship but are at the forefront of Roundup exposure — from seeking restitution.

This case could send an encouraging message to migrant and undocumented farmworkers who wish to bring legal action against the company. However, legal experts and farmworker advocates are still pessimistic about the prospect of them coming forward, especially when facing a myriad of hurdles and obstacles.

California researchers link popular weedkiller to health problems in young adults

Children exposed to a weedkiller commonly used in farming, as well as on residential yards and school playgrounds, appear to be at increased risk for liver inflammation and metabolic disorders in young adulthood and more serious diseases later in life, according to a study published Wednesday in the journal Environmental Health Perspectives.

The research, which was conducted by several California scientists and health researchers, including from the University of California, Berkeley School of Public Health, is the latest of many studies linking glyphosate herbicide to human health problems.

Glyphosate is better known as the active ingredient in Monsanto’s Roundup products as well as scores of other weedkilling brands sold around the world. The chemical is considered the most widely used herbicide in history, and residues are commonly present in food and water, as well as in human urine.

Monsanto and Bayer AG, which bought Monsanto in 2018, maintain that Roundup and other glyphosate-based herbicides are safe when used as directed, and say the weight of scientific evidence demonstrates that safety. But more than 100,000 people in the US have alleged exposure to the weedkiller caused them to develop non-Hodgkin lymphoma. Many independent scientific studies have linked glyphosate to cancers as well as liver disease, endocrine disruption and other health problems.

In the new study, researchers tracked 480 “mother-and-child duos” who live in the Salinas Valley of California, a key agricultural area, analyzing levels of glyphosate weed killer used in the area and levels of the weedkiller present in the urine of the mothers while they were pregnant and in the children as they grew. They also took into account levels of a degradation product of glyphosate known as AMPA in the urine of the study subjects. The researchers then assessed the liver and metabolic health of the children at the age of 18.

They concluded that higher levels of glyphosate residue and AMPA in urine in childhood and adolescence were associated with higher risk of liver inflammation and metabolic disorders in young adulthood. In addition, they found that agricultural use of glyphosate near participants’ homes from birth and up through age five was associated with metabolic disorders at age 18. Metabolic disorders in youth can lead to heart disease, stroke, type 2 diabetes, and liver disease later in life.

Both metabolic problems and liver disorders are increasing among children and young adults, according to the study.

New US research finds “worrying” evidence linking Monsanto weedkiller to cancer

New research by top US government scientists has found that people exposed to the widely used weed killing chemical glyphosate have biomarkers in their urine linked to the development of cancer and other diseases.

The study, published last week in the Journal of the National Cancer Institute, measured glyphosate levels in the urine of farmers and other study participants and determined that the presence of the pesticide was associated with signs of a reaction in the body called oxidative stress, a condition that causes damage to DNA. Oxidative stress is considered by health experts as a key characteristic of carcinogens.

The authors of the paper – 10 scientists with the National Institutes of Health and two from the Centers for Disease Control and Prevention (CDC) – concluded that their study “contributes to the weight of evidence supporting an association between glyphosate exposure and oxidative stress in humans.” They also noted that “accumulating evidence supports the role of oxidative stress in the pathogenesis of hematologic cancers,” such as lymphoma, myeloma and leukemia.

“Oxidative stress is not something you want to have,” said Linda Birnbaum, a toxicologist and former director of the National Institute for Environmental Health Sciences. “This study increases our understanding that glyphosate has the potential to cause cancer.”

The study findings come after the CDC reported last year that more than 80% of urine samples drawn from children and adults contained glyphosate. The CDC reported that out of 2,310 urine samples taken from a group of Americans intended to be representative of the US population, 1,885 were laced with detectable traces of glyphosate.

Glyphosate is the most heavily applied herbicide in history, both in the US and globally. One of the best-known glyphosate-based products is Monsanto’s Roundup weedkiller. Roundup has been used by farmers as well as consumers for more than 40 years. Monsanto has always assured the public and regulators that exposure to the weed killer does not pose a threat to human health, but many independent scientists say there is a wealth of evidence to contradict those assurances.

People are exposed to glyphosate by using products made with the chemical and also by eating food and drinking water contaminated with the pesticide. Scientists have found glyphosate residues in an array of popular foods and in waterways across the US.

Notably, in the new paper, the NIH and CDC scientists said that while their study focused on farmers who were exposed to glyphosate when they sprayed it on fields, they saw similar results in “non-farmers.”

The findings suggest “these effects may apply more broadly to the general population who are primarily exposed through ingestion of contaminated food and water or residential applications,” the study authors wrote.

The study is so significant that it warrants regulatory attention, said some independent scientists.

“This is a top level team of investigators and a highly credible study to which regulators need to pay attention,” said Phil Landrigan, a pediatrician and epidemiologist who worked for years at the CDC and the Environmental Protection Agency (EPA) and now directs the Program for Global Public Health and the Common Good at Boston College.

Michael Antoniou, a scientist with the department of medical and molecular genetics at King’s College in London who has been researching glyphosate for years, said the results were “worrying,” with “major health implications.”

Bayer facing long line-up of new Roundup trials as cancer takes toll

Cancer has taken an unrelenting toll on 72-year-old Mike Langford. After being diagnosed with non-Hodgkin lymphoma (NHL) in 2007 he suffered through five recurrences despite multiple rounds of chemotherapy and a stem cell transplant. Now he struggles with chemo-related neuropathy in his arms and legs, and new tests show the cancer is back.

Langford blames his cancer on his longtime use of the popular weed-killing product Roundup, which he applied countless times over decades using a backpack sprayer around his five-acre California property and a vacation lake home. He alleges in a lawsuit that Monsanto, the longtime Roundup maker now owned by the German company Bayer AG, should have warned of a cancer risk.

Last month, a San Francisco judge ruled that Langford’s health is so poor that he is entitled to a speedy hearing of his claims. A trial is set for Nov. 7 in San Francisco County Superior Court.

“I’ve had it so long. I’m very angry,” Langford said in an interview, a day after doctors biopsied an enlarged lymph node. “The future doesn’t look too terribly promising,” he said, trying to hold back tears. He learned last week that the preliminary biopsy results show a return of NHL.
